1. Who we are and what these terms cover

These Terms are an agreement between you and Timba2 (Pty) Ltd(registration 2023/542365/07), trading as Timbuk2 (“2Klip”, “we”, “us” or “our”). They govern your use of the 2Klip website and mobile app and everything available through them (the “Service”).

The Service includes accounts; Pin It and swipe games; skill-based competitions; missions and surveys; field-data and verification tasks; community features; leaderboards; referrals; buk2s and other rewards; and the 2Klip Market. A feature may not always be available.

These Terms must be read with our Privacy Policy, the App Privacy Addendum, and any clearly presented rules for a particular activity (“Activity Rules”). Activity Rules add the dates, eligibility, scoring, entry limits and reward details for that activity. If they conflict with these Terms, the Activity Rules control only the specific activity mechanic; these Terms and your rights under law continue to apply.

2. Accepting these terms

You accept these Terms when you create an account, tick or tap an acceptance control, enter an activity after being shown its rules, or otherwise use the Service. If you do not agree, do not use the Service.

Where the Service asks for an express acceptance, we may keep an electronic record of the version accepted and relevant activity entries, confirmations and communications. Electronic actions and records may be used as evidence to the extent allowed by law.

3. Eligibility and accounts

  • You must be at least 18 years old and legally able to enter this agreement. An activity may set additional lawful eligibility rules.
  • You may hold one account per person. Your details must be accurate, current and your own. Keep your login details and device secure.
  • You must have lawful access to the device, number, email address, payment method and third-party account you use.
  • We may reasonably verify your identity, age, location, eligibility or ownership of an account before allowing entry, awarding a reward or acting on a sensitive account request. We will not ask for more personal information than reasonably necessary.

You are responsible for activity on your account unless you promptly tell us it was accessed without permission. Contact support@timbuk2.ai if that happens.

4. Current free-entry model

No purchase or entry fee is required to enter the 2Klip games and competitions currently offered. You do not stake money, buk2s or anything else of value to take part, and you cannot lose buk2s by entering. Your network provider may still charge its ordinary data or messaging rates.

If we ever propose a materially different participation or payment model, we will first publish revised terms and the applicable Activity Rules. Continued use before that change does not amount to advance acceptance of it.

5. Games and skill-based competitions

2Klip may offer skill-based competitions. The Activity Rules will tell you the task, opening and closing times, who may enter, permitted number of entries, scoring method, tie-breaker, available reward and how a result can be queried.

In Pin It, for example, you use a supplied image and your local knowledge and observation to identify a real place and place a pin as close as possible to its verified location. Accuracy, valid submission time and the published tie-breaker determine the result. Location or device signals may be used to validate an entry and prevent fraud, but do not randomly decide the winner.

For swipe games, knowledge, attention, speed, accuracy or another skill identified in the Activity Rules may determine the score or reward. Nothing is won merely because a person paid, and current activities do not require a paid ticket.

Our systems record entries, timestamps, locations and scores. Those records are used to calculate results, subject to correction of a clear technical or scoring error and the review process in section 17. Where an Activity Rule permits multiple entries, each must be genuine and submitted through the same eligible account.

6. Rewards, prizes and buk2s

A reward is earned only when the applicable Activity Rules and validation checks are satisfied. Not every play, task or activity earns a reward. We may hold or reverse a reward obtained through a duplicate, invalid, manipulated or otherwise non-compliant entry, after a fair review.

Buk2s are 2Klip’s in-app reward units. For the redemption options we currently make available, 10 buk2s = R1. Buk2s are personal, non-transferable, cannot be sold or exchanged directly for cash, and have no value outside the redemption options shown in the Service. Buk2s do not currently expire. We will give reasonable notice before introducing an expiry rule.

Activity Rules identify any prize, its value or description, delivery method and claim deadline. We may substitute an unavailable non-cash prize with one of equal or greater value, unless law or the Activity Rules require another remedy. You are responsible for your own tax affairs, subject to any withholding or reporting duty imposed on us.

7. Missions, surveys and data tasks

Missions and surveys may ask you to observe, classify, verify or submit information. Field tasks may include photographs, audio, location, labels, notes or supporting metadata. The relevant brief explains the purpose, required format, validation rules and any reward.

  • Work only from a lawful, safe and appropriate place. Do not trespass, harass anyone, obstruct a business, take a physical risk or break a local rule to complete a task.
  • Avoid faces, children, vehicle registrations and other unnecessary personal information unless the task lawfully and clearly requires it.
  • Submissions must be your own, current, accurate and unmanipulated. Do not submit copied, fabricated, misleading, duplicate or stale content.

We may check completeness, duplication, location, time, media quality, classification and compliance with the brief. We may reject, ask you to redo or withhold a reward for work that does not meet the published requirements.

8. Community and user content

You remain responsible for content you post or submit. You promise that you have the right to submit it and that it is not unlawful, abusive, misleading, discriminatory, infringing or harmful. Do not expose another person’s private information without a lawful reason.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt and use that content only as reasonably needed to operate, moderate, verify, improve and promote the Service; fulfil the stated mission or campaign; and meet legal obligations. This licence ends when the content is deleted, except for completed campaign deliverables, lawful retention and copies already shared by you or at your direction.

9. Fair play and prohibited conduct

You must not:

  • use bots, scripts, emulators, location spoofing or automated methods to play, submit, vote or interact with the Service;
  • use multiple or borrowed accounts, collude, trade answers, farm entries or manipulate a score, result, referral or reward;
  • exploit a bug or bypass an access, security, eligibility, geographic or entry-limit control;
  • reverse engineer, scrape or interfere with the Service except where applicable law expressly permits it; or
  • impersonate 2Klip or another person, threaten or abuse anyone, or use the Service for an unlawful purpose.

10. The 2Klip Market

The 2Klip Market may let you buy physical goods. The product page and checkout show the seller, material product details, price in South African rand, applicable taxes and delivery or collection terms before you order. Displaying a product is an invitation to buy; your order is accepted when we send confirmation after successful payment.

Payment is processed by the payment provider identified at checkout. Card details entered with that provider do not reach 2Klip; we receive the payment status and transaction reference needed for the order.

You may cancel, return, repair, replace or refund a purchase where the Consumer Protection Act 68 of 2008, Electronic Communications and Transactions Act 25 of 2002, or another applicable law gives you that right. Contact support to start the process. Nothing in these Terms limits a consumer right that cannot lawfully be limited.

11. Our Service and intellectual property

We and our licensors own the Service, software, designs, branding, content and databases, excluding your content and third-party material. We give you a limited, personal, revocable, non-transferable licence to use the Service for its intended purpose while you follow these Terms.

The Service may link to third-party services. Their terms and privacy practices apply when you use them. We are not responsible for a third-party service merely because we link to it, but this does not remove any responsibility we have under applicable law.

12. Privacy, permissions and communications

Our Privacy Policy and App Privacy Addendum explain what personal information we process, why, which providers assist us, and your choices. A device permission is requested when a feature needs it. You may refuse a permission, although that feature may then not work.

We may send service messages needed for login, security, an activity, reward, order or account. Marketing is separate: where consent is required, we ask for it, and every person may opt out without deleting their account.

13. Closing or deleting an account

You may request deletion from Settings in the mobile app or follow the public instructions at Delete your 2Klip account. The deletion page explains verification, timing, what is erased, what law requires us to retain, and how to request a copy of your information first. Disconnecting Google or Facebook alone does not delete your 2Klip account.

Account deletion is permanent. You lose access to the account and any unredeemed buk2s. A pending order, payment, dispute or legal retention requirement may require us to keep limited records as explained on the deletion page, without keeping the account open for play.

14. Suspension and termination

We may limit or suspend an account while we investigate a reasonable suspicion of fraud, unsafe conduct, unlawful activity, material breach of these Terms, a security risk or harm to others. Where appropriate, we will explain the reason and give you a fair opportunity to respond. We may terminate for a serious or repeated breach, or when reasonably required by law.

We may change, pause or discontinue a feature for operational, safety, legal or commercial reasons. If an active activity is materially affected, we will apply its published cancellation or remedy rules and any rights you have under law.

15. Availability, responsibility and limits

We aim to provide a safe and reliable Service, but networks, devices and third-party systems sometimes fail. We do not promise uninterrupted or error-free access, a minimum amount of work, a minimum income, a reward for every play, or permanent availability of any feature.

To the fullest extent the law allows, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable when these Terms were accepted. Nothing excludes or limits liability that cannot lawfully be excluded, including your rights under the Consumer Protection Act.

You are responsible for loss you directly cause through fraud, wilful misconduct, unlawful content or a material breach of these Terms, but only to the extent permitted by law.

16. Changes to these terms

We may update these Terms when the Service, law or our operating model changes. We will publish the updated date and give reasonable advance notice of a material change through the Service or your registered contact details. A change does not retrospectively alter a completed activity or remove a right you already have.

17. Questions, complaints and disputes

Contact support@timbuk2.ai with the account email or phone number and enough detail for us to investigate a score, reward, purchase, restriction or other issue. We will review our records and respond within a reasonable time. If a short Activity Rule query period applies, it will be displayed before entry.

South African law governs these Terms. We first try to resolve a dispute in good faith. Nothing prevents either party from using a court or a regulator with jurisdiction, and nothing limits a consumer’s right to approach the National Consumer Commission or another lawful forum. Privacy complaints may be sent to the Information Officer listed above or the Information Regulator of South Africa.

18. General

If a court finds one provision invalid, the rest continue to apply. Our failure to enforce a provision once is not a waiver. You may not transfer these Terms or your account without our written consent; we may transfer them as part of a genuine restructuring or sale, provided your rights are not reduced. These Terms, the Privacy Policy, the App Privacy Addendum and applicable Activity Rules are the agreement about the Service.
